Executives Sentenced for Hiring Illegal Aliens

by Jim Kouri – SAN DIEGO — Two top executives for the Golden State Fence company were sentenced today for ignoring warnings by U.S. Immigration and Customs Enforcement (ICE) and repeatedly hiring unauthorized workers, capping the first federal prosecution of a California-based employer for illegal hiring practices.

At a hearing here this morning, U.S. District Judge Barry T. Moskowitz sentenced Golden State’s president, Melvin Kay, to three years probation, with 180 days of home confinement, and a $200,000 fine. The company’s vice president, Michael McLaughlin, was sentenced to three years probation, with 180 days of home confinement, and a $100,000 fine. In addition, the Judge ordered the Riverside, Calif., corporation to forfeit $4.7 million of proceeds generated by its illegal hiring practices.

“Meaningful employer sanctions, such as those imposed against Golden State and its principals, are an important component of criminal enforcement of illegal immigration across our border with Mexico,” said United States Attorney Karen P. Hewitt.

Golden State, which builds fences for residential, commercial and military projects throughout Calif., was first notified in writing in 1999 that at least 15 of its employees at its Oceanside, Calif., office were unauthorized alien workers following a visit by agents with the former Immigration and Naturalization Service (INS) in July of that year.

Former Senator and potential candidate for President Fred D. Thompson has the right idea:

He told Mike Wallace on Fox News Sunday:

“I’m concerned about the next 12 million or 20 million. So that’s why enforcement, and enforcement at the border, has to be primary.”

“I think most people feel disillusioned after 1986 when we had this deal offered to them before, and now we’re insisting that, you know, we solve the security problem first, and then we’ll talk about what to do with regard to other things — certainly no amnesty or nothing blanket like that.”

If we can make it nearly impossible for an invader to get a job and give the border patrol the authority and resources to arrest illegals and send them back where they came from, more than half the battle will have been won.

Thompson understands that if legal penalties are too high for employers to hire invaders and if government doesn’t give them free health care and a host of other undeserved benefits, there will be next to nothing left to attract them or keep them here. Again, FDT to Wallace:

“You know, if you have the right kind of policies, and you’re not encouraging people to come here and encouraging them to stay once they’re here, they’ll go back, many of them, of their own volition, instead of having to, you know, load up moving vans and rounding people up. That’s not going to happen.”


Thompson hits it on the head. When you remove the economic incentive and replace with with economic penalties and hardships, the problem begins to solve itself. While other so-called conservatives talk of amnesty, Thompson stands up for American sovereignty and the rule of law. His message is clear. Hey mi amigo, if you think we’re going to re -write our laws to suit your agenda, you’ve got another thing coming. That’s not how we roll.
